Website Terms of Use and Privacy Policy

Important: This is a binding legal agreement (this "Agreement"). Please read these terms and conditions of use carefully before using this site.

This Agreement is by and between you and Retirement Learning Center, LLC (referred to herein as "RLC", "we", "us", or "our") and sets forth the terms and conditions governing your use of RLC’s Web site currently located at the URL www.retirementlc.com and any successor site (the “Site”), as well as our privacy policy and practices. BY ACCESSING THE SITE, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT. If you do not accept all of the terms and conditions of this Agreement, do not use the Site. From time to time, changes in law or in the RLC business may require RLC to update this Agreement, and your continued use of the Site constitutes your acceptance of such changes. Accordingly, you should review these terms from time to time for such changes. RLC, in its sole discretion, may also add, delete or change some or all of the features of the Site or RLC’s services at any time. The terms "you" and "your" as used herein refer to all individuals and/or entities accessing the Site for any reason.

Ownership of Site Materials

All materials contained in the Site (the “Site Materials”) are the copyrighted property of RLC, or its subsidiaries or affiliated companies and/or third party licensors. No material from the Site or any Internet site owned, operated, licensed, or controlled by us or our affiliates may be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, except that you may make a single copy of the contents of this Site for your own personal, internal, non-commercial purposes. You may not remove any copyright or other proprietary notices, or create any derivative works, from any of the Site Materials.

All trademarks, service marks, trade names and trade dress used in connection with the Site are proprietary to us or our affiliates or licensors, including, without limitation, the marks RETIREMENT LEARNING CENTER and INDEPENDENT THOUGHT LEADERSHIP. You may not frame or utilize framing techniques to enclose any of our trademarks, logos, or other proprietary information (including images, text, page layout, or form) without our prior express written consent.

If you believe that any information or content owned by you, has been used on the Site in a manner that constitutes copyright infringement, please email RLC’s Copyright Agent at [jkiffmeyer@retirementlc.com] with a notice that includes the following information:

  • an electronic or physical signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  • identification of the copyrighted work claimed to have been infringed;
  • a description of where the material that you claim is infringing is located on the Site;
  • your address, telephone number, and e-mail address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • a statement by you, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Links to Third Party Sites

The Site provides links and pointers to Internet sites maintained by third parties. RLC does not operate or control in any respect any information, advertisements, products, or services on these third-party sites, including, without limitation, the sites located at www.plansponsor.com and www.plansponsorinstitute.com. Unless expressly set forth in the Site, RLC does not endorse, and is not responsible for the content or operation of, any such third party sites (or the products or services described therein). You assume all risk of accessing such third party sites, including responsibility for reviewing the terms of usage and privacy policies of those sites.

User Submissions

To the extent the Site offers message boards, chat rooms or other public areas, RLC disclaims any responsibility for the comments of individual users. All participants are expected to observe normal commercial standards of behavior and to conduct themselves lawfully and without violation of the rights of any third parties, and any user violating those standards may be barred from further participation. All user submissions to RLC, either through this Site or via e-mail, will be considered non-confidential and non-proprietary. Users may not submit copyrighted or confidential information belonging to another party without the express permission of the owner of such material and without identifying it as such. Users should note that any material or communications submitted by users (whether in original or edited form) may be republished, copied or otherwise used commercially or non-commercially by RLC without compensation and with or without attribution.


On our Site we collect information that you voluntarily provide in order for us to respond to messages and comments you provide to us through the Site, including, to the extent you provide it, your email address, first and last name, address, and phone number. This information will be used solely to respond to your inquiries and requests, and may be used internally by RLC in an aggregated format to better understand the demographics of users of the Site and the nature of their inquiries. We do not share your contact information with any third party without your consent, except to a court or governmental agency if required by law, as required by a court of competent jurisdiction.

We may also collect information regarding users’ access and use of the Site, such as web browser and operating system information, date and time of access to the Site, Internet protocol addresses, and related data, which information shall be used by RLC solely for our own internal purposes, to improve our services and the performance of the Site.


THE MATERIALS IN THIS SITE ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE PROVIDED "AS IS" AND RLC SHALL NOT BE LIABLE FOR YOUR RELIANCE THEREUPON. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, RLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITE AND ITS CONTENTS, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. RLC does not warrant that access to the Site will be uninterrupted or that the Site and its contents will be error-free, that defects will be corrected, or that this Site or the server that makes it available, are free of viruses or other harmful components. RLC does not warrant or make any representations regarding the use or the results of the use of the materials contained in this Site or in third-party sites in terms of their correctness, accuracy, timeliness, reliability or otherwise. Under no circumstances shall RLC be liable for any direct, indirect, incidental, special, or consequential damages (including, without limitation, damages for lost profits, loss of revenue, business interruption or loss or damage to data) that result from the use of, or the inability to use, the Site or any of its content, even if RLC has been advised of the possibility of such damages, whether a claim is asserted in contract, negligence, tort or otherwise.

This Agreement is governed by the laws of the State of New York, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this Agreement shall lie exclusively with the state or federal courts within New York, New York. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use provided by RLC for areas of the Site, a particular "Legal Notice," or other notices provided by RLC on particular Web pages, this Agreement constitute the entire agreement between you and RLC with respect to the use of the Site.
